1. Introduction
1.1 It Takes A Dream On-line Terms and Conditions of Sale
Welcome and thank you for accessing the It Takes A Dream on-line shop. Please read these User Terms and Conditions ("T&Cs”) before using this site which is owned and operated Aimer Tout (“we”, “us” or “our”), carefully before placing your order. By continuing to purchase items you agree to be bound by these T&Cs. By using this site, you signify your acceptance of these conditions in return for which we will provide you with access. From time to time we may modify the conditions so please continue to review the conditions of use whenever accessing or using this site. If at any time you do not wish to accept these conditions then you may not use this site.

2.2 When we refer to “It Takes A Dream”, “we” or “us”, we mean Aimer Tout, or where applicable, its affiliates. Where we refer to “you” or “your” we mean you, the customer.
3. The Basis Of The Contract
3.1 These Terms and Conditions of Sale (“T&Cs”) govern the sale of goods by us, It Takes A Dream, to you, the customer, via our website at www.ittakesadream.com and also by email at enquire@ittakesadream.com, and will form the basis of any contract of sale between us. 3.2 We reserve the right to make changes to any part of these T&Cs from time to time so please ensure that you check the latest version on our website. If you do not agree to any changes, please do not proceed with your order. If you do proceed to purchase, you will be bound by the updated and current version.
4. Your Eligibility To Purchase
4.1 In order to purchase items on our website, you must be the holder of a valid debit/credit card and provide us with your genuine and accurate personal information (name, phone number, email address, delivery address etc) as requested.
4.2 The products that you purchase are for your personal use only and are not to be purchased for resale or any other commercial gain.
5. The Order Process
5.1 All orders are subject to acceptance in accordance with the following process: Your placement of an order constitutes an offer to purchase goods from us. We will confirm receipt of your order by sending you a confirmation email summarising the details of your order. This does not mean that your order has been accepted. We will send you a second email when your product is dispatched. At this point your offer is accepted by us and a contract is formed.
5.2 We may sometimes be unable to supply you with a product, in which case your offer will not be accepted. For example, if:
1 The product you ordered is unavailable;
2 We are unable to obtain authorisation for payment or there is a problem receiving your payment;
3 We have identified a pricing or product description error;
4 The quantity of products ordered exceeds restrictions placed upon us by our suppliers;
5 You fail to meet the eligibility to order criteria set out above;
6 The transaction does not comply with our company policy; or
7 We suspect fraudulent or illegal activity.
5.3 We also reserve the right to refuse or reject any order entirely at our discretion at any time, and to restrict the quantity of a product being shipped to any one customer or delivery address.
5.4 If there are any problems with your order, we will contact you. If you have already paid for products and your order is not accepted, we will refund the full amount paid including any delivery charges as soon as possible.
6. Our Products
6.1 All products shown on the website are subject to availability. The products that you place in your basket are not reserved and can be purchased by other shoppers.
6.2 We reserve the right to withdraw any products from the website at any time and/or remove or edit any materials or content on the website.
6.3 As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to a particular product may change. If a product you have ordered becomes out of stock after we have accepted your order, then we will not be liable to you for being unable to provide that product. If this situation arises we will notify you as soon as possible and you will not be charged for the unavailable product.
6.4 Please note that images of the products (and any associated packaging) on the website are illustrative only. Whilst we have made every effort to display the products featured on the website as accurately as possible, the colours we use, and the display and colour capabilities of your computer monitor, will greatly affect the colours you actually see on the screen. We cannot be held responsible for the limitations of technology and cannot guarantee that your monitor's display will accurately reflect the colour, texture or detail of the product.
6.5 We reserve the right to amend the dimensions, specifications, descriptions and quantities of items displayed on our website without prior notice.
7. Pricing And Payment
7.1 All prices listed on our website are in Indian rupee currency. The prices of the products are as stated on the website at the time that you submit your order. We take all reasonable care to ensure that the prices of products are correct at the time when the relevant information was entered onto the system.
7.2 Prices do not include delivery charges. Delivery charges depend on the products you have ordered and the delivery address. The delivery charges for your order will be clearly displayed during the check-out process, before you confirm your order. 7.3 For orders delivered within India, these prices include an 18% General Sales Tax applicable, but exclude delivery costs, which will be added to the total amount due as set out on the relevant page of our site.
7.4 Customs and duties charges are not included and remain the responsibility of the recipient when purchasing for delivery outside of India.
7.5 Our website contains a large number of products. It is always possible that, despite our reasonable efforts, some of the products on the website may be incorrectly priced.
If we discover an error in the price of the products you have ordered we will contact you to inform you of this error as soon as possible. We also reserve the right to cancel your order once accepted if priced incorrectly.
Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
7.6 Refunds for orders placed for delivery within India as well as for international orders will be made to the same issuing bank from where the transaction was initiated, in Indian rupees, through one of the following payment
facilities: NEFT/ RTGS/ or any other banking, electronic funds transfer system approved by the Reserve Bank of India.
7.7 We currently accept the following payment methods: credit/debit cards: Amex, Visa, Mastercard as well as PayPal, Google Pay, Paytm and others.
7.8 You confirm that you have the legal right to use any credit or debit card, or other payment method, used for your purchase. By placing an order you authorise us to carry out any necessary credit checks and to transmit and/or obtain information (including updated information) about you to/from third parties for that purpose and in order to verify your identity, validate your credit or debit card, to obtain an initial card authorisation and to protect against fraud. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
7.9 In the absence of negligence on our part, we will not be liable for any loss you may suffer if a third-party procures unauthorised access to any data that you provide when ordering from our website. For more information on how we protect your personal information please see our Privacy Policy.
8. Delivery
8.1 Delivery Options: Please see our Delivery Terms.
8.2 We deliver to all of India as well as internationally. We do not deliver to PO Box numbers. For international deliveries please select the country required at the top of the website.
8.3 Please note, any delivery to non-residential addresses, properties with multiple occupants, student/temporary accommodation, properties with mail room or concierge services for deliveries, as well as those with courier requests or account preferences allowing for safe place/deliver to a neighbour, are made at the customer’s own risk and we will not accept liability for any loss or damage of the delivered items.
8.4 The delivery times given on our website are estimates and are to be used as a guide only.
8.5 Please note that we are not liable for any delays caused by events outside of our control. If delivery is delayed by such events, we will contact you as soon as possible to let you know and we will take reasonable steps to minimize the effect of the delay. If there is a risk of substantial delay and your goods have not yet shipped, you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received. Delivery charges will be refunded at the standard rate only.
8.6 Most orders are delivered within 7 business days. Monday to Friday are considered as business days except for public holidays. Delays in delivery can occasionally occur around public holidays or at times because of unforeseen circumstances, but we do our best to provide timely deliveries to all our customers. Orders once shipped, cannot be cancelled.
9. Cancellation
9.1 As a consumer, you have the right to cancel the contract and claim a refund if your order is received in bad condition. We are happy to offer a refund on unsuitable items returned in accordance with our Returns Policy. If you wish to return your items you will need to notify us by email of your return within two calendar days of receiving the item and then return the items within four calendar days of the original purchase date in order to receive a refund. Original shipping charges for orders returned due to damage, will be refunded. Please see a list of conditions for return under Conditions for Return.
Please log into your It Takes A Dream account and locate the relevant order in order to register your return.
Within India: Please send your parcel via a registered courier company to the Return Address. Be sure to obtain a copy of the courier waybill and keep this copy until you have received your refund. We will provide email confirmation once we have safely received your parcel and a refund has been processed. Please note that we will not accept liability for goods that are not returned via a registered courier return service. Returns will not be accepted if they are sent via domestic post.
International: Please send your parcel via registered, traceable post or via a registered courier company to the Return Address. Be sure to obtain a copy of the certificate of the registered post or courier waybill and keep this copy until you have received your refund. We will provide email confirmation once we have safely received your parcel and a refund has been processed. Please note that we will not accept liability for goods that are not returned via a registered courier return service.
9.2 Please note that certain items are not cancellable or returnable and these are listed in our Returns Policy.
9.3 If you wish to cancel your order before it has been dispatched, please contact us at enquire@ittakesadream.com
10. Warranties
10.1 You warrant and represent to us that:
1 You are legally capable of entering into binding contracts;
2 You have full authority, power and capacity to agree to these T&Cs;
3 All of the information that you provide to us in connection with your order is true, accurate, complete and not misleading; and
4 You will be able to take delivery of the products in accordance with our Delivery Terms.
10.2 Subject to section 10.3 below, we warrant to you that:
A) we have the right to sell the products; 
B) the products are sold free from any charge or encumbrance, except as specified in these T&Cs; 
C) the products will reasonably correspond to any description published on our website; and
D) the products will be of satisfactory quality.
10.3 All of our warranties and representations relating to the supply of products are set out in these T&Cs. To the maximum extent permitted by applicable law and subject to Section 10.1, all other warranties and representations are expressly excluded.
11. Items Damaged In Transit
11.1 If your order has been damaged in transit, or the products delivered are not the products you ordered, we will at your request, and subject to availability, either exchange or replace these products without charge to you, or provide you with a full refund, if the fault is notified to us within two (2) days of you receiving the product. We may request proof of purchase and/or photos of the damage and packaging in order to enable us to investigate the matter with our courier and packing facility and will inspect the items on their return. If the fault is notified after two (2) days of your receipt of the product, please refer to our Returns Policy and, subject to the conditions being met, we will provide you with either an exchange or repair in accordance with the Consumer Protection Act.
12. Limits On Our Liability
12.1 The limits on our liability set out below are important contractual terms. Please read them carefully.
12.2 We accept no liability and shall not be responsible for any indirect, consequential, special, economic, or exemplary loses or damages however they may arise, whether foreseeable or otherwise.
12.3 The products are sold only for domestic and private use. We will not be liable to you, whether in contract, tort (including negligence) or otherwise for any loss or interruption to business, or loss of revenues, profits, goodwill or business opportunity.
13. Intellectual Property
13.1 This site and all materials, text, code, content, software, videos, music, sound, graphics, photographs, illustrations, artwork, names, logos, marks, formats, files, devices and links contained in it or linked to it (together “Content”) are protected by copyright, trade marks and other rights of intellectual property owned by us. Anyone accessing this site is entitled to view any part of it. However, the Content must not be used nor reproduced (in whole or part) for any other purpose including on or in connection with another website or publication or for direct commercial gain. Furthermore, any links to this site must be notified to and approved by us before they are created or steps are taken to create the same.
13.2 The trade marks used on the website are the registered and unregistered marks of Aimer Tout.
13.3 You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only. Any other use of the material and content of the website is strictly prohibited.
13.4 You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, or create derivative works of such material and content for commercial purposes.

15. No Warranty
15.1 This site and its content are provided "as is" excluding warranties of any kind, either express or implied, to the fullest extent permissible under applicable law. We accept no liability for functions contained on the site and make no warranty that the site will operate uninterrupted or error-free or that any defect will be corrected. We do not warrant that the site is compatible with your computer equipment or that the site or its server is free of errors, viruses, worms or "Trojan horses" and we shall not be liable for any damage you may suffer as a result of such destructive features.

16.1 Our goal is to provide complete, accurate, and up-to-date information on our website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. This site may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and some information may not be complete or current. We reserve the right to correct any errors, inaccuracies, or omissions—including after an order has been submitted—and to change or update information at any time without prior notice. We sincerely apologise for any inconvenience this may cause.

17.1 We welcome your comments and feedback regarding our website, goods or services. Please note, however, that all comments, feedback, ideas, suggestions, materials, information, and other submissions disclosed, submitted or offered to us using this website or otherwise (collectively, "Comments") are not confidential. You are solely responsible for your Comments and the consequences of providing Comments via our website or otherwise.
18. General
18.1 Unauthorised Use of Domain Name. From time to time, certain cyber squatters or other unauthorised persons may register in bad faith a confusingly similar domain name with the intention of taking unfair advantage of Aimer Tout's reputation and goodwill. The It Takes A Dream's website address on the Internet is ittakesadream.com. Any other domain name that appears to represent itself as being an It Takes A Dream website may not be related to us and may represent an unlawful infringement of our rights, reputation and goodwill. We are not responsible and cannot be held liable to any person for the contents of or anything related to these other unlawful purportedly 'It Takes A Dream' websites.
18.2 No Waiver. If you breach these T&Cs and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the T&Cs.
18.3 Severability. If any part of these T&Cs shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the T&Cs and shall not affect the validity and enforceability of any of the remaining provisions of the T&Cs.
18.4 Third-party Rights. The contract of sale for the products is between you and us. No third-party has any rights to enforce any of its terms.
18.5 Compliance with laws. The website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the website and any transactions conducted on or through the website.
18.6 Governing law. These T&Cs are governed by Indian law. Any contract for the purchase of products through the website and any dispute or claim arising out of the contract will also be governed by Indian law
